Your contract will be with ISON Management Limited, trading as Ameira Travel. All names, logos and associated domain names are trademarks of ISON Management Limited. We hold Air Travel Organisers Licence (ATOL 11293) for your financial security. This means your money will be refunded or you and your party repatriated if already overseas in the unlikely event of our insolvency.
When you buy an ATOL protected air holiday package from Ameira Travel you will receive a Confirmation Invoice confirming your arrangements and your protection under our Air Travel Organiser's Licence number 11293. In the unlikely event of our insolvency, the CAA will ensure you are not stranded abroad and will arrange to refund any money you have paid for an advance booking. For further information visit www.atol.org.uk.
Clause 2 Your Booking
When you have selected your flights, accommodation and other holiday services on our website, you will be given a unique reference number enabling you to book your holiday (subject to availability) when you telephone us.
You will be asked to pay for your chosen arrangements, and if available we will send you a Confirmation Invoice. A Contract will exist once this Invoice has been issued under the terms of these Terms and Conditions, governed by English Law and the jurisdiction of the English Courts. You may choose the law and jurisdiction of Scotland or Northern Ireland if you wish.
You must be at least 18 years old. By booking with us, you are deemed to have read and accepted these conditions on behalf of all persons in the party.
Clause 3 Hotel Only Bookings
All hotel only bookings made online through the hotel only online portal are subject to the terms and conditions set forth by the hotel and the third party supplier. Ameira Travel acts only as an agent. Full payment is required at time of booking and 100% cancellation charges may be applicable. Any alterations will be treated as a cancellation. Ameira Travel is not liable for any errors made online by yourself at time of booking.
Clause 4 Your Information and Data Protection
When a booking is made all details will be emailed to you at confirmation. Please check that all names, dates and timings are correct and advise us of any errors immediately. Please ensure that the names given are the same as in the relevant passport.
If we are not informed of any errors within 24 hours of booking it will be assumed that all details have been checked and confirmed as correct. For our Data Protection Policy please see our Privacy Page.
Clause 5 Payments and Tickets
When you make a booking you must pay a non-refundable deposit of £99 per person or in some cases 10% of the value of the holiday, whichever is greater (excluding infants under the age of 2 years on the date of return).
The balance of the price of your travel arrangements is payable Eight (8) weeks prior to departure. If the balance is not paid on time, we shall cancel your travel arrangements and retain your deposit. If a booking is made within eight weeks of departure, full payment is required immediately.
Payment can be made by Visa, Mastercard or American Express. If a third party credit/debit card is used, written authorisation from the cardholder is required. Refunds take up to 14 working days to process.
Clause 6 Price
All bookings with an air element include Scheduled Airline Failure Insurance premium and an ATOL fee. Prices can be varied due to transportation costs, fuel, government action, VAT, or exchange rate variation.
In the case of any decrease in price, the original cost of the holiday remains the same. New offers are applicable only to new bookings and cannot be retrospectively applied. If a price increase exceeds 10% of your travel arrangements, you may cancel and receive a full refund of all monies paid, except amendment charges.
Clause 7 Insurance
We consider adequate travel insurance to be essential and strongly advise you and all members of your party to obtain it prior to departure for the full period of your trip. We strongly advise a policy covering: cancellation costs; assistance and repatriation in the event of accident or illness; loss of baggage and money; and other expenses. It is your responsibility to ensure that the insurance policy you purchase is suitable and covers your requirements.
Clause 8 Changes Made by You
Any request for changes must be in writing from the person who made the booking. You will be asked to pay an administration charge and any further costs we incur in making the alteration.
| Change Type | Admin Fee |
|---|---|
| Changing Destination | £100 |
| Changing Names (where permitted by airline/hotel) | £75 + airline charges & fare difference |
| Changing Dates | £75 |
| Any Other Changes (room type, board basis, upgrades, etc.) | £35 |
Hotel, airline or supplier fees are charged additionally. Any amendment resulting in a lower booking value will be treated as a cancellation. Name changes are not permitted on flights once a booking confirmation has been issued — a new ticket must be purchased at the full applicable fare.
Clause 9 Cancellation by You
Written notification from the lead person on the booking (from the email address on the reservation) must be received. Cancellation charges apply as follows:
| Period Before Departure | Cancellation Charge |
|---|---|
| Over 56 days | Loss of deposit |
| 42 – 56 days | 50% |
| 22 – 41 days | 75% |
| Within 21 days | 100% |
If only some members of your party cancel, we will recalculate the holiday cost for remaining travellers, and additional charges such as single room supplements may apply. No refund will be made after departure on any part-used holiday components.
Clause 10 Changes or Cancellation by Us
If we make a major change to your holiday, you may accept the change, accept alternative arrangements, or cancel for a full refund. Compensation (except where changes arise due to force majeure) is as follows:
| Notice Period | Compensation Per Person |
|---|---|
| More than 56 days | £0 |
| 56 – 42 days | £10 |
| 41 – 22 days | £20 |
| 21 – 0 days | £30 |
If we cancel your holiday, you will receive a full refund of the holiday cost plus the applicable compensation above (deposit only if more than 56 days prior). The compensation offered does not exclude you from claiming more if you are entitled to do so.
Clause 11 Our Liability to You
(1) Packages: We accept responsibility for ensuring your travel arrangements are supplied as described. Where any part is not provided as promised due to the fault of our employees, agents or suppliers, we will pay appropriate compensation. Our liability is limited to a maximum of twice the costs of your travel arrangements.
We accept responsibility for death, injury or illness caused by negligent acts and/or omissions of our employees, agents, suppliers and sub-contractors. Compensation may be limited by international conventions including the Montreal, Athens, Berne and Paris Conventions.
(2) Other Arrangements: We promise to use reasonable skill and care in making your booking and arranging your accommodation, transfers and flights.
(3) Local Excursions/Activities: We will not accept responsibility for services which do not form part of our agreement or are not advertised on our website. Excursions or activities booked locally are not part of your package and your contract will be with the local supplier, not with us.
Clause 12 Complaints Procedure
If you have any dissatisfaction during your holiday, please inform the relevant supplier immediately who will endeavour to put things right. If unresolved locally, obtain a written report from the supplier and follow up within 28 days of your return home by writing to our Customer Services Department:
Please include your booking reference and all relevant information. Failure to follow this procedure may affect your rights under this contract.
Clause 13 Conditions of Carriage
When you travel with a carrier, the conditions of carriage of that carrier apply, some of which may limit liability. These conditions are incorporated into this contract.
Under UK Law (Regulations 261), you have rights in some circumstances to refunds and/or compensation from the airline in cases of denied boarding, cancellation or delay. Full details: view legislation. Reimbursement in such cases is the responsibility of the airline and will not automatically entitle you to a refund of your holiday price from us.
Please note that charter and low-cost carriers, as well as some scheduled airlines, do not always include luggage, meals or seat requests in the holiday price. Please contact our customer service team for details.
Clause 14 Special Requests, Medical Conditions and Disability
Special requests will be passed on to the relevant supplier but cannot be guaranteed. Pre-booked seats are not guaranteed and the airline reserves the right to reallocate seat numbers. If you have paid extra for a seat not provided, we will arrange a refund with the airline.
If you or any member of your party has a medical condition or disability which may affect your booking arrangements, you must advise us in writing at the time of booking with full details so we can advise on the suitability of your chosen arrangements.
Clause 15 Final Travel Arrangements
Please ensure that all your travel, passport, visa and insurance documents are in order and that you arrive in plenty of time for checking in at the airport.
Clause 16 Behaviour
You will not be entitled to a refund if you are prevented from travelling by any person in authority who feels you are unfit to travel or likely to disturb other passengers. We reserve the right to end your holiday if your behaviour causes distress or damage to other passengers, employees, guests or accommodation. In these circumstances no refund or compensation will be provided, and we may recover costs incurred as a result of your behaviour.
Clause 17 Passport, Visa and Health Requirements
It is each traveller's responsibility to ensure they have a valid UK passport, relevant visa(s), and comply with all health requirements for the duration of their journey. All passports must be valid for at least 6 months after your return to the UK. All Ameira Travel package holidays and hotel only bookings are only available to UK passport holders.
Travellers to the USA must obtain electronic travel authorisation via the Electronic System for Travel Authorisation (ESTA) at esta.cbp.dhs.gov. The current ESTA fee is $40.37. ESTA authorisation is valid for two years or until passport expiry, whichever comes first.
The Foreign, Commonwealth and Development Office provides travel advice by country: www.gov.uk/foreign-travel-advice
Clause 18 Delivery of Documents
All Ameira Travel documentation and vouchers will be sent via email. Please contact us no later than three working days before your departure if you have not received your travel documents. Failure to do so may result in extra charges being levied by the airline.
Clause 19 Locally Booked Excursions and Activities
Optional excursions and activities offered during your holiday are provided by independent local companies, not owned or controlled by Ameira Travel. If you purchase such an excursion, your contract will be with the local company which provides it, and it will not form part of your package or contract with Ameira Travel.
It is your responsibility to ensure you have adequate insurance cover for any such activity, and Ameira Travel accepts no liability for any failure to ensure you have adequate cover.
Clause 20 Website Accuracy
Although Ameira Travel makes every effort to ensure the accuracy of website information and pricing, errors do occasionally occur. You must check the price and all other details of your chosen arrangements with us at the time of booking and on your confirmation.
Clause 21 Insolvency Protection
We provide financial security for flight-inclusive packages via our Air Travel Organiser's Licence number 11293, issued by the Civil Aviation Authority, Gatwick Airport South, West Sussex, RH6 0YR · Tel: 0333 103 6350 · [email protected].
When you buy an ATOL protected product from us you will receive an ATOL Certificate listing what is financially protected. The price of our flight inclusive arrangements includes the amount of £2.50 per person as part of the ATOL Protection Contribution (APC) we pay to the CAA.
For further information visit www.atol.org.uk.
Clause 22 Your Financial Protection
When you buy an ATOL protected flight or flight inclusive holiday from us you will receive an ATOL Certificate. This lists what is financially protected, where you can get information on what this means for you and who to contact if things go wrong.
Agreement with consumers about form of ATOL protection
We, or the suppliers identified on your ATOL Certificate, will provide you with the services listed on the ATOL Certificate (or a suitable alternative). In some cases, where neither we nor the supplier are able to do so for reasons of insolvency, an alternative ATOL holder may provide you with the services you have bought or a suitable alternative (at no extra cost to you). You agree to accept that in those circumstances the alternative ATOL holder will perform those obligations and you agree to pay any money outstanding to be paid by you under your contract to that alternative ATOL holder. However, you also agree that in some cases it will not be possible to appoint an alternative ATOL holder, in which case you will be entitled to make a claim under the ATOL scheme (or your credit card issuer where applicable).
Agreement with consumers of assignment of the consumer's claim where the consumer receives a benefit from the Air Travel Trust
If we, or the suppliers identified on your ATOL Certificate, are unable to provide the services listed (or a suitable alternative, through an alternative ATOL holder or otherwise) for reasons of insolvency, the Trustees of the Air Travel Trust may make a payment to (or confer a benefit on) you under the ATOL scheme. You agree that in return for such a payment or benefit you assign absolutely to those Trustees any claims which you have or may have arising out of or relating to the non-provision of the services, including any claim against us, the travel agent (or your credit card issuer where applicable). You also agree that any such claims may be re-assigned to another body, if that other body has paid sums you have claimed under the ATOL scheme.
Clause 23 Law and Jurisdiction
This booking is governed by English Law, and the jurisdiction of the English Courts. You may however choose the law and jurisdiction of Scotland or Northern Ireland if you wish to do so.
